Personal Safety Intervention Order

A Personal Safety Intervention Order (PSIO) differs from an FVIO as the protected person is not a family member. A PSIO is a legally enforceable order that contains conditions that determine how a respondent can behave towards the protected person, their children, and their property. Parties involved in these disputes often relate to neighbours, work or school colleagues.

To get a PSIO, an applicant to be able to demonstrate to the court that they are a person who requires protection from the respondent due to their prohibited behaviours towards them.  The applicant must be able to demonstrate that the respondent engaged in these prohibited behaviours which can include assault, harassment, stalking, property damage and threats.

An applicant must also persuade the court that the respondent is likely to continue or repeat the behaviours and that the behaviours are likely to cause a reasonable person fear for their safety.
